Civil vs. Criminal
Civil law is based upon a published code of statutes, as
opposed to law found in the decisions of courts. Civil law
is the body of law that determines private rights and
liabilities, as distinguished from criminal law. It is a
private action that is prosecuted by the injured party.
Criminal law is the branch of the law that specifies what
conduct constitutes crime and establishes appropriate
punishments for such conduct. Criminal law is an act against
society that is prosecuted by the government.
When a crime is committed it may fall under civil or
criminal law, or it may constitute both.
An act may be prosecuted in both civil and criminal
courts when it is a criminal act committed against an
individual or group. For example, possession of drugs
constitutes a criminal offense, but if no other party is
involved there is probably not cause for a civil action. On
the other hand, if a crime such as kidnapping is committed,
it is considered a crime against society, as well as a crime
against an individual or the individual's family.
